③ Basics of Patent Search (Hybrid Search)

We will explain the basics of patent research.

The basic principle when creating a search query is to create a hybrid of the following three elements ①, ②, and ③.

There are three parts: 1) "Selection of search terms," 2) "Selection of FIs," and 3) "Selection of F-terms."

The first step is to select terms.

・List the "technical subject matter" (terms, concepts, etc.) described in the claims.

・These include the term in question, ingredient names, synonyms, alternative names, broader terms, related terms, purpose, use, structure, material, characteristics, function, shape, form, effect, manufacturing method, method, control, treatment, operation, means, product, etc.

・Then, the term in question is sorted into broader terms and related terms.

Next, ② "Selection of FI".

In this case, we will take into consideration the top and bottom rankings for each.

Then, proceed to create a search formula to obtain the parent set.

Here, in the "Specific Example" section, we describe "chamomile," one of the ingredients used in cosmetics.

A total of 1,809 cases (S7) were obtained as the survey population.

In the next example, "carboxymethyl cellulose," we obtained 3,779 results (S8).

As mentioned above, the basis of patent research is to grasp the "technical subject" described in the claims and carry out three steps: ① "selection of search terms", ② "selection of FI", and ③ "selection of F-terms".

The idea is to create a hybrid formula of "①+②+③" for the same "technical subject."

Regardless of the type of patent search (prior art search, invalidity document collection search, infringement search, etc.), the basic approach is to create this hybrid format.

特許調査の基本について述べます。

基本原則は、検索式の作成で、以下の①と②と③の３者の混成式を作成することです。
①「検索用語の選定」、②「ＦＩの選定」および③「Ｆタームの選定」の３者です。
先ずは、①「用語の選定」です。
・【請求項】の中に記載の『技術主題』（用語・概念など）のリストアップをします。
・これらは、当該用語、成分名、同義語、別名、上位語、関連語、目的、用途、構造、材料、特徴、機能、形状、形態、効果、製法、方法、制御、処理、操作、手段、製品などです。
・そして、当該用語と上位語・関連語に仕分けをします。
次に、②「ＦＩの選定」です。
・『技術主題』に付与されていると思われる「ＦＩ」をリストアップします。
・この際、当該ＦＩ分類と上位ＦＩ分類を見分けておく必要があります。
更に、③「Ｆタームの選定」です。
・『技術主題』に付与されていると思われる「Ｆターム」をリストアップします。
・この際、当該Ｆターム分類と上位Ｆターム分類を見分けておく必要があります。
そして、同一の『技術主題』について、「①+②+③」の混成式（Hybrid Formula）を作ります。
この場合、それぞれについて上位・下位を十分考慮します。
そして、【検索論理式】作成へと進み、母集合を得ます。
「具体例」では、化粧料に配合する成分の一つである「カミツレ」について記載しています。
調査対象の母集合として、１,８０９件（Ｓ７）を得ました。
次の「カルボキシメチルセルロース」の例では、３,７７９件（Ｓ８）を得ました。
以上の如く、特許調査の基本は、【請求項】の中に記載の『技術主題』を把握し、①「検索用語の選定」と②「ＦＩの選定」および③「Ｆタームの選定」の３者を行い、
そして、同一の『技術主題』について、「①+②+③」の混成式（Hybrid Formula）を作成することにあります。
如何なる種類の特許調査（先行技術調査、無効資料収集調査、侵害調査　等々）であろうが、基本はこの混成式（ハイブリッド）を作成することです。
