しかし、この商標が登録されるまでには拒絶理由が複数回通知され、複数回の意見書を提出するなど様々な経緯がありました。
色の商標を登録するのはかなりハードルが高いです。このような有名商標でも登録には苦労したのですから。結果的には、膨大な資料を提出することで、この商標の周知性を立証して商標登録されました。
However, there was a lot of back and forth before this trademark was registered, including multiple notifications of reasons for refusal and multiple written opinions submitted in response.
It is quite a hurdle to register a trademark consisting of colors, as shown by this case, in which even a famous trademark has had a hard time getting registered. The trademark was eventually registered after Nissin Foods submitted a vast amount of material to prove the well-knownness of the trademark.
最初の拒絶理由では、
「商品又は商品の包装に使用される色彩は、色彩を組み合わせたものも含め、多くの場合、商品の魅力向上等のために選択される」という理由で識別力がないと判断されました。
In the first reason for refusal, it was judged that the trademark has no distinctiveness as “the colors, including combinations thereof, used for the goods or the packaging of the goods are often chosen to enhance the attractiveness of the goods or similar.”
クリスチャン ルブタンの赤い靴底の商標出願(2015-29921号)に対しても拒絶理由が通知されたことは、このブログでお話ししました。この一色からなる商標には結局、拒絶査定が下され(J-PlatPatの記録によると、不服の審判が請求され、審理終結通知がされた)、チキンラーメンの包装の色のように、色の組み合わせからなる商標にも拒絶理由が通知されました。結論として、色彩の商標は周知性を立証できない限り、登録は難しいということです。
