【日英対訳】(株)明治の「R-1」など商標登録
(株)明治の
「R－１」(商標登録6593375号)
「LG２１」（商標登録6593374号）
という商標が登録されました。ヨーグルトのブランドとしてお馴染みです。これら商標が登録されたことは画期的です。なぜなら、ローマ字１文字、文字、数字、簡単な記号は識別力がないため、登録されないからです。これら商標も識別力なしとして、拒絶査定になっていますが、不服の審判を請求して拒絶査定は覆されました。
英訳
R-1 (trademark registration no. 6593375) and
LG21 (trademark registration no. 6593374)
have been registered as trademarks by Meiji Co., Ltd. These are both well-known yogurt brands.
The registration of these trademarks is unprecedented. This is because one or two roman letters, numbers, and simple symbols do not have distinctiveness and therefore are not normally registered as trademarks.
A final refusal was handed down due to lack of distinctiveness, however this was overturned after an appeal was filed against the decision.
全国的に使用されていて周知であるとの主張をしたからです。
これら商標の登録が重要なのは、ロゴや社名との組み合わせではなく、文字のみからなる商標が登録されたという点です。
今回の登録は、文字単独でも「明治のあの商品だ！」と認識できることの証拠になります。

皆さんは、これらの文字を見て、明治のヨーグルトを連想できるでしょうか？
私は連想できました。それだけこれらの文字がヨーグルトブランドとして浸透しているということです。
This is because Meiji asserted that the trademark was in use nationwide and was therefore well-known.
What is important about the registration of these trademarks is that they were not registered in combination with a logo or company name, but rather, they consist of letters only.
This registration is evidence that characters alone can be recognized as being “products by Meiji.”

Would you be able to associate these characters with Meiji yogurt?
I could. This shows how well these characters have entered the public consciousness as yogurt brands.
