【日英対訳】佐賀県の小学校がイラスト掲載で著作権侵害
佐賀県の小学校が、インターネット上で見つけたイラストを学校だよりに掲載しましたが、著作権侵害といわれ、11万円の賠償金を支払うそうです。

An elementary school in Saga Prefecture is to pay 110,000 yen in compensation for using an illustration they found online in their school newsletter. It was claimed that the illustration infringed on the illustrator’s copyright.
この小学校は、
「フリー 無料 風鈴」
というキーワードで検索して見つけた画像ですが、実は著作権フリーではなかったそうです。
The elementary school found the illustration by searching online using the following keywords:
“free, no charge, wind chimes"
However, the illustration was not in fact copyright free.
この学校はこのイラストは、学校だよりに掲載し、学校のウエブサイトにも転載したそうです。
そして、弁護士から損害賠償として11万円の請求書が送達され、学校はこれに応じるそうです。
The school used the illustration in print copies of their school newsletter, then uploaded the newsletter pages to their website. An attorney served the school with a bill for 110,000 yen as compensation for damages, which is what the school will reportedly have to pay.
この事件を聞いて「著作権は恐い」と思う方が多いでしょう。
A lot of people might think that copyright is scary when they hear about this case.
学校は著作権の知識が全くなかったわけではなく、無料素材としてネット上で探したものが実は著作権フリーではなかったのです。
It wasn’t the case that the school had no knowledge at all of copyrights; rather, the “free” materials they found online were not actually copyright free.
検索の結果表示されたページには著作権の記載はなかったとのこと、しかし、イラスト制作者のページには著作権の記載があり、このイラストを誰かが引用し、このページを学校が見て、このページからイラストを転載したらしいです。
While the original webpage featuring the illustration did include a copyright statement, the unrelated page that came up in the search results apparently did not include any copyright statement. It appears that someone else published the illustration to that webpage, then the school came across the page and took the illustration.
他人のイラストを使うときは、しつこい位に著作権を調べればいけないと、痛感する事件でした。
This incident has made me keenly aware that we should be careful when checking for copyrights of illustrations created by others.
