【日英対訳】「ルビーロマン」の商標を石川県が韓国で出願
「ルビーロマン」という商標を石川県が韓国で出願しました。
これは石川県が14年もかけて開発したぶどうの名前です。ルビーロマンの苗木が韓国に流出したらしく、韓国でこの名前のぶどうが発売されていました。DNA鑑定の結果、韓国で販売されていた苗木の遺伝子型が石川県が開発したものと一致したそうです。

Ishikawa Prefecture has applied to trademark “Ruby Roman” in South Korea. This is the name of a grape variety that Ishikawa Prefecture spent almost 15 years developing. It appears that Ruby Roman seedlings somehow made their way to South Korea, with a grape variety of the same name being sold in the country. DNA analysis showed that the genotype of the seedlings being sold in South Korea matched the genotype of those developed by Ishikawa Prefecture.
韓国では2019年頃、「ルビーロマン」の商標が第三者により登録されました。英語、ハングル、カタカナ文字で登録されたが、これらは無効にされたそうです。
In South Korea, trademarks for “Ruby Roman” were registered by a third party around 2019. It is reported that these were registered in English, Korean, and katakana alphabets, but are now invalid.
韓国の商標法では、商標が消費者間である者の商品、サービスを指定するものとして認識されている場合、その商標を使用することでその者の商品やサービスと混同を生じさせるおそれがある場合は、その商標を無効にすることができます（韓国商標法７条、71条）。この規定により取り消されたと予想します。
Under South Korean trademark law, when a trademark is recognized among consumers as specifying an entity’s goods or services, then in a case where the use of that trademark is likely to cause consumers to mistake that entity’s goods or services with another entity’s goods or services, the trademark can be invalidated (Korean Trademark Law, Articles 7 and 71). I assume that the trademark was cancelled under this provision.
早く登録されて石川県の名産が韓国で保護されることを願っています。
I hope that Ishikawa Prefecture’s trademark registration will go through right away so that this specialty product will be protected in South Korea.
