〈日本語が読めればわかる検討会の「とりまとめ」で決まったこと〉

〈「大麻等の薬物対策のあり方検討会」とりまとめを公表します～大麻等の薬物対策のあり方に関する基本的な方向について～〉と題された全19ページの報告書が公表された。

この検討会はこの報告書の「はじめに」にも書かれているように〈「大麻規制のあり方」 の検討を中心に、「社会復帰支援を柱とする薬物乱用者に対する再乱用防止対策」、「医療用麻薬及び向精神薬の規制」、一次予防、二次予防、三次予防いずれにも配慮した「普及啓発及び情報提供」について〉おこなった議論をまとめたものだ。

令和３年６月25日、「医薬・生活衛生局　監視指導・麻薬対策課　課長補佐　山根　正司　薬物乱用防止係　赤石　美生」の名で公表された厚生労働省が発表した正式な報告書だ。

中身を精査する前に報告書17ページにあるとりまとめの一番キモである「おわりに」という「とりまとめ」のとりまとめ部分をみてみよう。

「おわりに
厚生労働省は関係省庁と連携を行いつつ、本検討会のとりまとめの具体化に 向けた検討作業を速やかに進め、法改正等の一定の時間を要する提言について も、可能な限り速やかに取り組むことを求める。」

この「おわりに」という報告書のとりまとめ部分にあたる文章は、検討会の第6回で提示され、第7回で修正、第8回で承認されたものだ。

修正前と修正後を比べると以下のようになる。

（前）法改正などの時間を要する制度改正についても、可能な限り速やかに取り組むことを求める。

（後）法改正などの一定の時間を要する提言についても、可能な限り速やかに取り組むことを求める。

「制度改正について取り組む」から「提言について取り組む」へとわざわざ変更されている。「とりまとめ」において「制度改正」ではなく「提言」に取り組むように〈提言〉されているということになる。

これは、全8回、半年間に及ぶ「検討会」において、厚労省から厳選された有識者（12人の委員）が出した最終結論であり、検討会が厚労省に求めたのは「制度改正」ではなく、まずは「提言」に取り組むことだ。さらにこの報告書は厚労省と鈴木議長が修正して公表した報告書であり、正式文書、ファイナルアンサーだ。

この「おわりに」を噛み砕いて言うならば、もっと検討しろっていう結論に過ぎない。しかし、厚労省は「今回の検討会を受けて」という段取りを踏んで法改正に向けた審議会などの次のステップに進もうとしている。そしてメディアもそのように報じているが、果たして今回の検討会および報告書は次のステップへ移行するための段取りとなっているかというと疑問を感じざるを得ない。

「検討会」および「報告書」の法的根拠や正当性について述べるには僕の法知識は浅い。しかし、「検討会」、そしてそこで語られまとめられた「報告書」は決して軽くみて良いものではないだろう。もう一度、「大麻等の薬物対策のあり方検討会」でとりまとめられた「大麻等の薬物対策のあり方に関する基本的な方向」について読み直すことを求めたい。

ただし、膨大で読みにくい議事録を読み返せと言うのでもなければ、とりまとめ全文を読み返せというつもりもない。厚労省が半年かけて作り上げた検討会の集大成である「とりまとめ」の最後の３行、「おわりに」を読み返せば自ずと答えは導き出されるはずだ。

しつこいようだが、改めて読んでみよう。

〈法改正などの一定の時間を要する提言についても、可能な限り速やかに取り組むことを求める。〉

素直に読めば「提言」と「制度改正」のあいだには大きな開きを感じるのは僕だけではないはずだ。

「大麻等の薬物対策のあり方」という大きなテーマを掲げた検討会の結論だ。稚拙に急ぐ必要はなく、じっくりと「法改正などの一定の時間を要する提言」について取り組むべきだろう。ただし、「可能な限り速やかに取り組むことを求め」ていきたい。

How to read the "Study Group on Measures to Prevent Marijuana and Other Drugs" Part 1

If you can read Japanese, you can understand what was decided in the "summary" of the study group.

The 19-page report titled "Summary of the Study Group on Measures to Prevent Marijuana and Other Drugs" has been released.

As stated in the introduction of the report, the committee summarised its discussions on "the state of cannabis regulation", "measures to prevent re-abuse by drug abusers with a focus on supporting their reintegration into society", "regulation of medical narcotics and psychotropic substances", and "awareness-raising and information provision", taking into account primary, secondary and tertiary prevention. The following is a summary of the discussions we had on these issues.

This is the official report published by the Ministry of Health, Labour and Welfare on 25 June 2021 under the name of "Masashi Yamane, Assistant Director, Monitoring, Guidance and Anti-Narcotics Division, Pharmaceutical and Consumer Health Bureau, Drug Abuse Prevention Section, Misao Akaishi".

Before we examine the contents of the report, let's take a look at the most important part of the report on page 17, which is the summary of the report called "Conclusion".

 Conclusion
The Ministry of Health, Labour and Welfare (MHLW), in collaboration with the relevant ministries and agencies, is urged to proceed promptly with the study to put the summary of this study into practice, and to work as quickly as possible on proposals that require a certain amount of time, such as amendments to the law.

This "Conclusion", which is the summary of the report, was presented at the 6th meeting of the study group, revised at the 7th meeting and approved at the 8th meeting.

A comparison of the text before and after the amendment is as follows

(Before) It is requested that systemic amendments that require time, such as legal amendments, be tackled as quickly as possible.

(After) We urge that proposals that require a certain amount of time, such as legislative amendments, be tackled as quickly as possible.

This is a deliberate change from "work on institutional reform" to "work on recommendations". This means that in the "Summary", it is "suggested" to work on "recommendations" instead of "systemic revision".

This is the final conclusion reached by the MHLW's hand-picked panel of experts (12 members) during the eight sessions of the six-month-long "study group", and the MHLW's call for the MHLW to work on "recommendations" rather than "systemic reform". Furthermore, this report is the report that MHLW and Chairman Suzuki revised and published, and it is the official document, the final answer.

To put it crudely, this "concluding remarks" is nothing more than a conclusion for further consideration. However, the MHLW is trying to take the next step, such as a council meeting to revise the law, by saying that it will follow this study. And while the media is reporting this, one has to wonder if the study group and its report are really a stepping stone to the next step.

My knowledge of the law is too limited to discuss the legal basis and justification for the panel and report. However, the panel and the report it produced should not be taken lightly. I would like to ask you to re-read the "Basic Direction on the Way of Countermeasures against Marijuana and Other Drugs" compiled by the "Study Group on the Way of Countermeasures against Marijuana and Other Drugs".

However, we are not asking you to read back the huge and difficult to read minutes, nor are we asking you to read back the entire report. If you read the last three lines of the summary, which is the culmination of six months of work by the MHLW, you should be able to find the answer.

Let's read them again.

We call on the government to work as quickly as possible on proposals that require a certain amount of time, such as amendments to the law.

I'm sure I'm not the only one who feels that there's a big gap between "recommendations" and "systemic reform" if you read it straight.

It is the conclusion of a study group that has taken up the major theme of "how to deal with marijuana and other drugs. There's no need to rush into anything prematurely, and the panel should take its time in addressing "proposals that require a certain amount of time, such as legal amendments". However, we would like to urge them to work on it as soon as possible.
