Here is the summary and comments for the final episode of “Isn’t that Plagiarism?” (NTV, Wednesdays at 10:00 p.m.).
月夜野ドリンクがいよいよ「カメレオンティー」の発売を目前にしていた矢先、競合社のハッピースマイルビバレッジがこの技術の特許を取得しました。
Just as Tsukiyono Drinks was about to finally launch its Chameleon Tea, a competitor, Happy Smile Beverage, obtained a patent for the technology.
月夜野はカメレオンティーを特許出願せずに、営業秘密として保持しておく、という選択をしました。ケンタッキーフライドチキンのスパイスがいまだに営業秘密として公開されていないのと同じです。
Tsukiyono had chosen not to file a patent application for Chameleon Tea, keeping it instead as a trade secret. This is just like the Kentucky Fried Chicken spice mix, a trade secret that has never been made public.
競業者にこの技術の特許を取得され、特許侵害と月夜野が主張された以上、特許出願しなかったという選択は誤っていたことになります。
With the technology being patented by a competitor and Tsukiyono being accused of patent infringement, the choice not to file a patent application turns out to have been a mistake.
しかし、なぜ営業秘密は競合社に漏れたのでしょうか？
実は、月夜野の社員がハッピースマイルの研究者に漏らしていました。この2人は恋人関係にありました。
However, why was this trade secret leaked to the competitor? Actually, an employee at Tsukiyono leaked it to a researcher at Happy Smile. The two were in a romantic relationship.
営業秘密が漏洩する際には、
① 窃取など不正取得
② ライセンサーなど、営業秘密を正当に開示された者がこれを不正に利用する場合が不正競争防止法に規定されています。営業秘密を恋人に漏らした月夜野社員は研究部門ではなく、総務部に属していました。つまり、営業秘密に正当にアクセスできる状態にはなかった者です。
The Unfair Competition Prevention Act defines that trade secrets are leaked through:
(i) illegal acquisition such as theft, and
(ii) unlawful use by a person to whom they were rightfully disclosed, such as a licensor.
The Tsukiyono employee who let slip the trade secret to his partner belonged to the General Affairs Department, not the Research Department. In other words, he was not in a position where he would have legitimate access to trade secrets.
したがって第三者による窃取と同じです。
Thus, it is the same as theft by a third party.
この証拠を亜季がつかみ、ハッピースマイルは訴訟を取り下げ、カメレオンティーは販売できることとなりました。
Once Aki had this evidence in hand, Happy Smile dropped the lawsuit and Chameleon Tea could go on sale.
亜季も知財部員として成長しました。
