桐島聡逮捕における時効の有効性について思ったこと

導入

1974[昭和49年]に東アジア反日武装戦線による連続企業爆破事件が引き起こされた。事件は全解決しておらず、ほぼ迷宮入りという状況に陥っていたのは皆さんもご存じのことでしょう。しかし、2024年の50年たった今にとある男が自首をしました。その男の証言によると自分は国際指名手配を受けている桐島聡であるという。DNA鑑定にかけた結果、照合に整合性が見られたということから、私はこの男が50年前に世間を騒がせた指名手配犯であるのだとニュースを見ながら確信しました。
そこで、私は時効の有効性について疑念を抱いた。

時効の有効性について

近年、殺人事件における時効の期限が延長されて、無期限となった。どれほど、事件から時間が経ようと起訴される可能性があるということである。
そもそも時効が、設定されていた背景には事件が劣化するまた、証拠収集が困難になることなどが挙げられるという。しかし、殺人事件ほどの事件となると、遺族の喪失感も加味した上で激情感情が消えうせるということは考えずらいことからの変更であったと考えました。
これらを踏まえた上で、個人的には時効を延長することには同意するが、
無期限にする必要はないように感じた。刑事事件に熟知しているわけではないが、完全犯罪を成し遂げていた場合に迷宮入りする事件もあるのは確かであるからである。時間とは永遠に左から右へ流れていくものであることから、ある限りで区切りをつけるというは事件捜査の将来への意義の観点から重要であるという風に感じた。
一つの事件を解決することに、一生の労力を捧げる人が尽くす必要がある。
それらは、まるで永久機関の製造に熱意を燃やす中世の物理学者のように感じてしまった。

Statute of limitation, police giving up to arrest criminal, was banned in 2010 by Ministry of justice.
I thought which is proper abolition and continuation.
I disagree to ban statue of limitation because the evidence gets vague as time passed. In other words, it should be promoted to continue statute of limitation.
Now in Japan, they had been twenty-five years, before they were banned. Even if the length of time were longer, the possibility to arrest the criminal would be little.
For example, Kirishima Satoshi who caused bombing incidences, and in famous for Suspect Wanted. Police tried to look for him without giving up but failed to arrest.
What could make them to flee from police`s investigation? One of the reasons for it is what there was few clues at all.
Police only had picture of him and had nothing except it. With this in mind, there is things we can find, but on the other hand, there are the things we cannot find permanently.
If they had been dead in something accident, it would look for man who had already passed away. It is exactly nonsense.
I can understand the insistence that bereaved feel sad forever, but the permanent investigation is too long to try to look for them.
Because they might have changed their face by operation. It is hopeless.
