What does it mean that the claims are the same?
Claims are an important part of the patent specification that indicates what is claimed as a novel invention.
In other words, if the claims are found to show an invention identical to the claims in the prior case, the patent will be rejected. 

But what is the basis for determining that they are identical?
What is the basis for Book = 本(ほん)?
Are book and 本 the same?
Belief in identity is essential to patent practice.
What is needed to make people believe that symbols of obviously different forms (e.g. Book and 本) are the same thing?
