センチネル(Sentinel) データ利用条件

Sentinel データの利用条件について調べました。

センチネル（Sentinel）データとは

欧州連合(EU) の地球環境の計測・モニタリングを継続的に行う Copernicus プログラム（英語）というものがあります。これは人工衛星で宇宙から観測したデータと地球上で観測したデータがあり、そのうち人工衛星とその観測装置の衛星がセンチネル（Sentinel = いわゆる見張り）として名付けられています。

どこから入手できる

Copernicus Open Access Hub （英語）から入手できます。EO browser （英語）というのもあります。
どちらも同じデータのソースからダウンロード可能で、登録は必要ですが、無料でデータをダウンロードできます。

利用条件

Sentinel データの配布条件はEUの法律 1159/2013 によって定められています。

以下に、簡単に要約します。
他の法律を破ったり知的財産侵害を起こさなければ、データに対して完全にオープンかつフリーなアクセスを提供しています(下記（５））。また、広くデータを提供するために、利用の目的や品質に適しているかを保証することはしないこととしています（１１）。
また、複製、配布、公開、改変やそれらを組み合わせた目的の利用もOKです（Article 7）。
配布や公開の際には、データの出展を明らかにし、改変がある際はその旨を明示しなければなりません。

最後に、知的財産権については、利用条件（英語）によると、Primary product（Sentinel データそのもの）, Altered Product （Sentinel データと明らかな相関性が維持された、利用者が知的財産を活用せずに得られるデータ：例えばヒストグラムやオルソ処理、リサンプルされたデータ等）の知的財産権は、衛星のオーナーのまま維持されます。これらを配布・公開する際には、コピーライトを明示する必要があります。

一方、Derivative product（元のSentinelデータに復元できる相関性を有さない利用者が作成したデータ：例えば、被覆分類や植生指数など）は、利用者がそのデータの知的財産権を有します。しかし、このデータを配布・公開、あるいは他の人がアクセスできるようにする際には、Copernicus プログラムのデータを含んでいることを明示する必要があります。

(5) Access to Sentinel data should be free, full and open, in line with the Joint Principles for a Sentinel Data Policy 
(11) In the interest of a wide distribution of GMES data and information, it is appropriate not to provide for any express or implied warranty, including as regards quality and suitability for any purpose.

Article 7
Conditions regarding use
1. Access to GMES dedicated data and GMES service information shall be given for the purpose of the following use in so far as it is lawful:
(a) reproduction;
(b) distribution;
(c) communication to the public;
(d) adaptation, modification and combination with other data and information;
(e) any combination of points (a) to (d).
2. GMES dedicated data and GMES service information may be used worldwide without limitations in time.

Article 8
Conditions regarding information to be given by users
1. When distributing or communicating GMES dedicated data and GMES service information to the public, users shall inform the public of the source of that data and information.
2. Users shall make sure not to convey the impression to the public that the user’s activities are officially endorsed by the Union.
3. Where that data or information has been adapted or modified, the user shall clearly state this.

Sentinel データは、無料でアクセスでき、商用利用も可能な人工衛星データです。多様なデータが利用できますので、利用条件を遵守し、上手に活用しましょう。
