「これにより」が意味する２つのこと

特許明細書の英訳ではこんなシンプルな表現にも毎回悩まされます。

パーキングロック状態においてストッパ６６はサポート部材３０側へ突き出す突出姿勢となるため、坂路での駐車の際にパーキングポール４０をパーキングギヤ４４から押し出す押出し荷重が発生し、その押出し荷重がカム機構９６を介してロック部材４２に加えられると、ロック部材４２とサポート部材３０との間でストッパ６６が挟圧される。これにより、ストッパ６６がロック部材４２に作用する押出し荷重の一部を担うため、押出し荷重に基づいてロック部材４２に加えられるロック解除位置側へ後退する方向の力が低減されて、その後退によりパーキングポール４０がパーキングギヤ４４から抜け出すＰ抜けが抑制される。

請求項６に記載の画像形成装置によると、転写部材は、ローラ本体の周面に対して一端部が固定され、一端に対してローラ本体の径方向外側に向かって延びる他端部が移動可能な可動部材を備える。可動部材は、ローラ本体の回転に伴い、ローラ本体と搬送ベルトとの接触位置を通過し、接触位置に対して搬送ベルトの移動方向下流側で、搬送ベルトの転写部材側の面と接触する。これにより、ローラ本体の径を小さくしても、現像剤像担持ベルトと搬送ベルトとの離間時における剥離放電を低減し、良好な画像形成が可能となる。

上記引用①および②の「これにより」は、それぞれ別のことを示していることにお気づきでしょうか。

まず前者は、「物理学的作用」について述べています。それに対し、後者は「ローラ本体を小型化する」、「剥離放電が起こることを低減する」という「論理的帰結」を述べています。

特許明細書では「作用効果」という言葉が良く用いられます。前者は「作用」すなわち物理学的な作用であるのに対し、後者は「効果」、つまり必ずしも物理的因果関係になくてもよく、例えば「風が吹けば桶屋が儲かる」のような論理上の、かつ間接的な因果関係として描き出す必要があります。

特徴として前者は客観的描写になるのに対し、後者は「小型化される」「低減される」「容易になる」等、比較的主観的な表現になるという傾向があるように思われます。

前者は物理的作用、すなわち原因と結果の連鎖を明確化する必要があるのに対し、後者は目的と手段の関係を明確化する必要があるのです。

つまり、「これにより」という同じ言葉で表現されていることであっても、この二つは明確に区別されるべきと私は考えます。

前者の「これにより」、すなわち物理的帰着は、例えば実験結果のように「こうしたら自ずとこうなる」と言った厳密な意味での因果関係になります。これは「作用」や「結果」という言葉で言い表すことができます。

後者の「これにより」の後には「効果」すなわち論理的帰着が続き、そこには発明により達成したかったこと（目的）が記載されます。そしてその背後には解決したい課題があります。この部分こそ「発明の有用性」に相当するものであり、翻訳においてもこの流れを作り出す必要があります。

つまり、この文脈での「これにより」は「これを手段として（目的を達成することができる、課題を解することができる）」というように訳さなければならないのです。
