国連・子どもの権利委員会の第90会期が終了――ウクライナに関する特別作業部会も設置

　ジュネーブ（スイス）で5月3日から開催されていた国連・子どもの権利委員会の第90会期が終了しました。

　プレスリリースはまだ出ていませんが（追記：6月8日に出ました。日付は6月3日付です）、閉会会合の様子は UN Web TV のアーカイブ動画で見ることができます。なお、大谷美紀子委員長は恒例の人権条約機関委員長会合（5月30日～6月3日）に出席するためニューヨークに出張中なので、閉会会合の議長はアユービ－イドリッシ（Hynd AYOUBI IDRISSI）副委員長が務めました。

　OPIC（通報手続に関する子どもの権利条約の選択議定書）に基づく個人通報の処理状況については、7件の通報について決定を採択し、そのうち次の4件について条約違反を認定したと報告されています。

1）チリ：国際的奪取の対象とされた子どもの送還について
2）ジョージア：公立幼稚園における体罰に関して実効的調査が行なわれなかったことについて
3）デンマーク：FGM（女性性器切除）の危険性があるソマリアへの子どもの送還について
4）デンマーク：ジェンダーに基づく暴力の被害者である子どもと母親のインドへの送還について

　また、▽スペインが被申立国である通報2件（保護者のいない未成年者の年齢鑑別手続について）と、▽スロバキアが被申立国である通報1件（アフガニスタン出身の庇護希望家族をダブリンIII規則に基づいてオランダに送還したことについて）に関しては審理の打ち切りが決定されました。決定はそのうち第90会期のページに掲載されますので、内容を確認したらまた紹介します。

　また、これまでに条約違反を認定した事案に関するフォローアップ報告書も採択されたとのことです。

　個人通報制度との関係で注目したいのは、委員会がウクライナに関する特別作業部会（ad-hoc working group）を設置したことです。マーシャル－ハリス（Faith MARSHALL-HARRIS）副委員長兼報告者の報告によれば、これは、とくに市民社会組織やウクライナ人権コミッショナーから提出される通報に対して迅速に対応することを目的とするものです。ロシアはOPICを批准していないため、ロシアを直接の被申立国とする通報は受理不能となるはずですが、ウクライナはOPICの締約国であるため、条約上の保護義務などの不履行については審査の対象とすることができる可能性があります。

　なおウクライナは、2016年9月にOPICを批准する際、2014年にロシアに「併合」されたクリミア自治共和国とセワストーポリ市に加え、ドネツク州・ルハンスク州の一部地域について、OPICの実施は限定され、保証できない旨の解釈宣言を行なっています。
　また、マーシャル－ハリス副委員長が言及した「ウクライナ人権コミッショナー」とはウクライナ議会人権コミッショナーのことと思われますが、議会によって5月31日に解任されたとのことです。ENNHRI（国内人権機関欧州ネットワーク）とGANHRI（国内人権機関世界連合）は6月3日付でウクライナ議会議長宛てに公開書簡を送り、深刻な懸念を表明しています。

　このほか、2021年9月に開催された「子どもの権利と代替的養護」に関する一般的討議の報告書も採択されたとのことですので、公表されたら、委員会の勧告を日本語訳して紹介します。

　今会期で行なわれた報告書審査の様子については、プレスリリースの見出しを日本語訳してFacebookで紹介してきましたが、以下に再録しておきます。審査結果を踏まえた総括所見は6月9日（木）に第90会期のページで公表される予定です。

　監護事件における子どもの異議申立て権というのは、2021年の子ども法改正により、監護、居所または面会交流に関する取り決めについて子どもが不服を有する場合、子どもが地区委員（District Commissioner）に申立てを行ない、これらの問題に関する議論に親の参加を求めることができるというものです（プレスリリースでは「子どもの豊かな成長のためのサービス統合法」（Act on the Integration of Services in the Interest of Children’s Prosperity）によるものとされていますが、文書回答のパラ92によれば、改正子ども法に基づく権利のようです）。興味深い対応です。

　カナダの審査で取り上げられている「ヨルダン原則」というのは、ファーストネーションズ（先住民族）の子どもを対象とする支援サービスのあり方について定めたものだとのことです。ファーストネーションズの子どもの状況にかなり焦点が当てられたようですが、COVID-19（新型コロナウイルス感染症）パンデミックが子どものメンタルヘルスに及ぼした影響、体罰の全面禁止の可能性などについても取り上げられています。カナダに関する前回の総括所見（2012年）の日本語訳はこちらを参照。
