11月22日、エストニア議会の11名の議員は、世界保健機関（WHO）に対し、「パンデミック条約」または「パンデミック協定」とも呼ばれる、パンデミック予防の準備と対応に関する国際協定案を拒否する書簡を提出した。  この書簡はまた、国際保健規則（2005年）（以下「IHR」）の改正も拒否している。

先月私たちは、2022年5月に世界保健総会（WHA）が、各国が将来の国際保健規則の改正から脱退する期間を短縮することに静かに合意したことを説明する記事を掲載した。これまで各国がオプトアウトしていた18ヶ月という長い期間を維持するためには、2023年12月1日までに、2022年にWHAで決定された改正からオプトアウトするという簡単な書簡をWHOに送る必要がある。

エストニアの国会議員からの書簡の日付は2023年11月22日で、12月1日の期限の8日前である。国会議員たちは、単に2022年にWHAで決定された修正案から脱退するだけでなく、さらに踏み込んで、パンデミック条約案とIHR修正案の両方を全面的に拒否し、WHOへの追加資金拠出も拒否したのである。

エストニアのオルタナティヴ・メディア・サイト『Telegram.eee』が指摘しているように、これは昨年初めに下された決定と矛盾する。  2022年3月4日、エストニアの欧州連合委員会（European Union Affairs Committee、以下「EUAC」）は、欧州委員会がエストニアに代わってWHOの2つの文書について交渉する権限を有するかどうかについて投票するための会議を開催した。

EUACはエストニア議会（Riigikogu）の常設委員会であり、欧州連合（EU）に関連する問題について決定および調整の役割を担っている。エストニア政府はEUACの決定に拘束され、欧州での議論においてこれらの決定を利用する。政府がEUACの決定に従わない場合は、その理由をEUACに提示しなければならない。

El 22 de noviembre, 11 diputados del Parlamento estonio escribieron una carta a la Organización Mundial de la Salud ("OMS") para rechazar el acuerdo internacional propuesto sobre preparación y respuesta ante una pandemia, también conocido como "Tratado sobre Pandemias" o "Acuerdo sobre Pandemias".  La carta también rechaza las enmiendas al Reglamento Sanitario Internacional (2005) ("RSI").

El mes pasado publicamos un artículo en el que explicábamos que en mayo de 2022 la Asamblea Mundial de la Salud ("AMS") acordó discretamente reducir el periodo durante el cual las naciones tienen que optar por no participar en futuras enmiendas al Reglamento Sanitario Internacional. Para que los países conserven el periodo más largo de 18 meses que se les permitía anteriormente, deben enviar a la OMS una breve nota en la que indiquen que se excluyen de las enmiendas decididas por la AMS en 2022 antes del 1 de diciembre de 2023.

La carta de los diputados estonios está fechada el 22 de noviembre de 2023, 8 días antes de la fecha límite del 1 de diciembre.  Los diputados no se han limitado a rechazar las enmiendas decididas por la AMS en 2022, sino que han ido mucho más lejos y han rechazado tanto la propuesta de Tratado sobre la Pandemia como las enmiendas al RSI en su totalidad, así como la financiación adicional de la OMS.

Como señaló el sitio estonio de medios alternativos Telegram.ee, esto contradice una decisión tomada a principios del año pasado.  El 4 de marzo de 2022, el Comité estonio de Asuntos de la Unión Europea ("EUAC") celebró una reunión para votar si la Comisión Europea estaba autorizada a negociar los dos instrumentos de la OMS en nombre de Estonia.

La CAUE es una comisión permanente del Parlamento de Estonia (el Riigikogu) y tiene un papel decisorio y de coordinación en asuntos relacionados con la Unión Europea. El Gobierno estonio está vinculado por las decisiones de la EUAC y las utiliza en sus debates en Europa.  Si el Gobierno no sigue las decisiones de la EUAC, debe exponer a ésta las razones de su incumplimiento.

En la reunión de marzo de 2022, tres miembros del EUAC votaron en contra y nueve a favor de otorgar a la Comisión Europea la autoridad para iniciar negociaciones sobre un Tratado de Pandemia, enmiendas al RSI y mejorar la sostenibilidad de la financiación de la OMS en nombre de la República de Estonia.

Estonia notifies WHO that it rejects the Pandemic Treaty and amendments to International Health Regulations

On 22 November, 11 Members of the Estonian Parliament wrote a letter to the World Health Organisation (“WHO”) to reject the proposed international agreement on pandemic prevention preparedness and response – also known as the “Pandemic Treaty” or “Pandemic Accord”.  The letter also rejects the amendments to the International Health Regulations (2005) (“IHR”).

Last month we published an article explaining that in May 2022 the World Health Assembly (“WHA”) quietly agreed to reduce the period during which nations have to opt out of future amendments to the International Health Regulations. For nations to retain the longer 18-month period previously allowed for nations to opt-out, countries need to send WHO a short note that they are opting out of the amendments decided by the WHA in 2022 before 1 December 2023.

The letter from the Estonian MPs is dated 22 November 2023, 8 days before the 1 December deadline.  The MPs haven’t simply opted out of the amendments decided by the WHA in 2022, they have gone much further and rejected both the proposed Pandemic Treaty and the IHR amendments in their entirety as well as additional funding to WHO.

Kalle Grünthal, one of the MPs who signed the letter, broke the news on Facebook. The letter begins:

Hereby, the Republic of Estonia, based on Article 22 of the Statute of the World Health Organisation, declares that it rejects and does not consent to the international agreement on pandemic prevention, preparedness and response as well as complementary amendments to the International Health Regulations (2005) and to improving the sustainability of WHO funding.

As Estonian alternative media site Telegram.ee noted, this contradicts a decision made early last year.  On 4 March 2022, the Estonian European Union Affairs Committee (“EUAC”) held a meeting to vote on whether the European Commission was authorised to negotiate WHO’s two instruments on behalf of Estonia.

The EUAC is a standing committee of the Parliament of Estonia (the Riigikogu) and has a deciding and coordinating role on issues relating to the European Union. The Estonian government is bound by EUAC’s decisions and uses these decisions in its discussions in Europe.  If the Government does not follow EUAC’s decisions then it must provide EUAC with the reasons for not doing so.

At the March 2022 meeting, three members of the EUAC voted against and nine voted in favour of giving the European Commission the authority to open negotiations on a Pandemic Treaty, IHR amendments and improving the sustainability of WHO funding on behalf of the Republic of Estonia.

Now the Parliament of Estonia has spoken.  Below is a copy of the letter from the parliamentarians to WHO rejecting its Pandemic Treaty and IHR amendments.
