契約内容とか僕のプロジェクトの話

Facebook用に英語と日本語で書いてたらちょっと長めになってしまったので、なんとなく英語と日本語を交互に入れてみました。ｗ

A few days ago another Japanese band, SEBASTIAN X, announced that they had signed a record deal with one of the AVEX group companies.

↑つい数日前にメジャーデビューを発表した、SEBASTIAN Xとバンドさん。
YouTubeにそれをお祝いする曲を発表されてました。

I just simply wonder what kind of contract they got. 
Because, even as an indie band, they had always been one of the rare ones who could handle everything on their own and even regularly organize music festival events. 
Not that I have much of negative thoughts about signing up a record deal, though 
単純に、彼らがメジャーデビューする契約内容、というかメリットってなんだろうなと素朴に不思議に思っちゃいます。メジャーデビューすること自体に悪いイメージを持ってるわけではないですけど。
でも、インディーズ時代から、他のバンドさんを集めて自分たちで企画から運営までやれてしまうバンド。どんな内容なのか訊いてみたいです。

Me, I think, I don't need contracts with bands.
僕は、契約を結ぶ必要なんて無い。と思ってるんです。

Me (Actwitness) and the bands on Actwitness, including Yellow Studs, we don't have any official contract. Basically they are so perfectly DIY bands, skillful and knowledge, they wouldn't like it if they got tied up on any kinds of restricts or whatsoever, I believe. (Yellow Studs, in fact, said that they had once been had by some guys, haha.)

僕のプロジェクトActwitnessと、関わっていただいているバンドさん、僕たちは正式な契約とか結んでないっす。基本彼らは自分でなんでもやれる人たちだし、ちょっとした小さい制約とかがあると小回りが利かなくなってやりにくいんじゃないかな、と思うんです。（Yellow Studsは以前悪い大人に騙されたともどこかで言ってましたな。）

So, the last couple of weeks I'd been working on label-like stuff as a company, as though I was Yellow Studs' label, which, I am NOT. 
They are still very much of a DIY indie band. And I've been just helping them, that's all (´▽｀)

そんなわけで、僕は今会社としてYellow Studsさんのレーベル的なことをやっている感じになってますが、彼らは今もDIYです。完全にインディーズです。僕はちょっくらお手伝いさせて頂いているだけです。

Why I've been doing all this for their music distribution is, just simply the band's leader Taichi Nomura asked me to do so. (As for this, I'll write an entry another time.) And, I'm never ever going to impose any form of limitation or restriction on them. - Although not to mention I have a talk with them on this and that every now and then.

Well, it's because, again, I just don't think that contracts should necessarily be there. If / when either of us wishes to be off with the other, then that's it, we should be over. (Maybe it's as simple as this because it's only between me and Yellow Studs, with no third party). But then if, later on, we know that we can do something together for our both good, we can work together again I hope.
In my shoes, if YELLOW STUDS asked me to cease distribution, then I will immediately do so. 

僕が今回日本以外の世界に向けて音源配信をやらせていただいているのは、単にリーダーさんのTaichi Nomuraさんに頼まれたから（←ちょっとこの辺、またの機会に書きたいです。）なんですけど、でもそれでも俺から何の制約だとか契約を課すつもりも無いんです。※取決めどうするこうするとかの相談はしまっせ。
というのは、利益やら目的が同じなら別に契約とか要らないんじゃないかなと思ってるんですよね。手を切るときは少なくとも一方が、「手を切ったほうがメリット高いな」と思ったというわけで。じゃぁそれは手を切ればいいわけで。その後またメリットがあるなと思ったらまた一緒に何かやればいいのかな、と。
僕で言えば、Yellow Studsさんが「君のとこでやってる配信、止めて。」と言えばすぐ即座に止めます。彼らにとってはそのメリットがあると踏んだわけで、それは喜ばしい。僕は違うことをやればいい。

Perhaps, by not making an official contract, I might be deceived or ripped off by someone, somehow someday. To tell you the truth, I once WAS. Of course not by YELLOW STUDS, but the label of another indie band. 
- I got their approval for me screening their movie at my events, which I paid for entirely, then a short while after the movie got at 100% completion, they told me "please put this whole thing on a hold" then went out of communication. 

This could happen. So, maybe my way of thinking is a sort of a naive thought, unacceptable for some people out there. Well, this is MY thought, anyway, at least for the time being. 

I might be using that movie of that band anyways, though, because of course it will never harm them at all, it may possibly only give them good things, which are popularly overseas and, simply, money. Which is one of the points of my business scheme.
Although I won't know what'll happen after, I feel that will give a bit of spice to my life, and also to the Japanese music industry. (I'll be sorry if that will sadden my family or girlfriend, though - if there will be any!)

契約を組まないことで裏切られることとかあるのかも知れないです。つか正直僕も一度あるんですよね、反故にされたこと、Yellow Studsさんとは違うバンドさんというかそのレーベルさんに。ヨーロッパ上映するからって承諾もらって、僕がお金全部出して映像撮ってもらって編集してもらった後に『全部保留にして。』って言われたきり連絡取れないんですよね。
でも、おそらくオレ、その映像使っちゃうんじゃないかなｗ　だって、一回全部話して承諾もらってるからね。彼らに一銭も損させないビジネススキームだし。むしろ収益出たら勝手にお金送ってもいいくらい。
法的にどうなるかまだ分かんないけど、どうにかなったらそれはそれで面白いんじゃないかなぁと緩く考えてます。家族とか彼女（いればね）に迷惑かけるかも知れないけど。

But I think, even if deceived, I think that's the risk which naturally occurs when trusting someone. In another word, I trust someone only when I know I wouldn't regret if they deceived me.
In the first place, even if we made a contract and either one of us broke it, I wouldn't wanna cover the cost for pricey lawyers or go over complex procedures. x) Oh well. 
So, I don't resent those who "got" me. If someday they contact me saying they would like to do something again with me, I'll just say "Ah, sure!"

でも裏切られたとして、それは誰かを信頼した時に自然発生するリスクだと思ってるんす。つまり、『裏切られても後悔しない』っていう覚悟、というか価値が見いだせたから信頼する。
そもそも契約を組んだとして、契約壊されたときに弁護士立てたりとか難しいこととかしたくないし。（ぬるいです、はい。）　
だから別に、裏切った人たち恨まないし。またやりたいって言われたら「あ、おねがいしますー」って言える心持ち。

......... So, now I hope you've found my project and YELLOW STUDS interesting? 
Their new album has been released for a couple of weeks. 
Me, I totally do find their music really great (yeah, such a variety of vocabulary). Else I wouldn't be doing all this - having them make a movie, solely investing on it, distributing their music.

この間発売されたばかりのアルバム、というか彼らの音楽、ホントにいいと思ってます。（←雑ｗ）
ホントにいいと思ってるから映像作らせてくれって頼んだりお金出したり音源配信したりしようとしてるんです。

(Oh, and sorry to announce this but, for now, physical CD copies won't be on sale. xD Of course in Japan it should be, though!)

（あ、フィジカルなパッケージ販売はとりあえずやらないことにしましたよｗ　日本では勿論あると思いますけども。）

So, if you have read this post, some opinion -positive or negative- have popped up to your mind? Then that IS what I would like to hear and take in to grow up. 

そんなわけで、色んな方のご意見だとか受け止められるだけ受け止めて、やれるだけやって成長します。宜しければご意見お待ちしてます。

..... The bottom line is, I assume that SEBASTIAN X got a bunch of nice people, took some time thinking over and finally made their record deal. 
Everyone, please keep your fingers crossed to this one of the bands I wanted to ask onto Actwitness!! xD 

そんなわけで、きっとSEBASTIAN Xさんも、ブログで仰ってたように良い人たちとの巡り合わせがあって、且つよくよく考えた上で契約を結んだんでしょうな。
実はActwitnessにも誘わせて頂きたかったんですけど、ライブ観れなかったからできなかったんですよね。ｗ　そんな彼らに幸あれ！
