【英日対訳】声明「インターポールは子どもの性的搾取と性的虐待に関する『用語ガイドライン』に賛同する」｜ICPO国際刑事警察機構(2016.06.14)

はじめに
【翻訳の背景】日本の法律でいう"child pornography" (児童ポルノ) は、米国の法律では同様だが、国際刑事警察機構 (ICPO: インターポール) や欧州刑事警察機構 ( ECPO: ユーロポール) 、オーストラリアやタイ等の一部の国では、"child abuse material " (児童虐待表現物)とされている。
とくにINTERPOLでは、後者の使用を強く推奨しており、2016年6月には、国際ECPAT（本部・タイ）が主導し、ICPO自身も参加するInteragency Working Group on Sexual Exploitation of Children (児童の性的搾取に関する国際関係機関ワーキンググループ: IWG ) ※1が2016年1月に発表した用語ガイドライン "Terminology Guidelines for the Protection of Children from Sexual Exploitation and Sexual Abuse (児童を性的搾取及び性的虐待から保護するための用語ガイドライン (通称: 『ルクセンブルグ・ガイドライン』※2 ” に賛同する声明を発表した。
2014年から2015年の間、日本で署名運動が行われ1万人の署名を集めたという、ICPOが推奨する"child abuse material (児童虐待表現物)"という表現には、約2年間に及ぶ国際的な議論の経緯があった。その最新の表明としてICPOが満を持して行ったのが、この賛同声明だった。
表現規制問題に対する理解を深めるため、ICPO最新の声明の内容から、子どもの性的搾取と虐待に関する用語解釈に関する最新の国際潮流を把握したいと思い、勉強がてら訳出することにした。

INTERPOL supports new Guidelines on child sexual exploitation and abuse terminology

（スイス, ジュネーヴ）グローバルな関係諸機関によるワーキンググループ (IWG) が発表した “Terminology guidelines for the protection of children from sexual exploitation and sexual abuse（児童を性的搾取及び性的虐待から保護するための用語ガイドライン)” は、子どもの性的搾取と性的虐待の問題に取り組む協力体制の強化に向けた重要な一歩となる。
GENEVA, Switzerland - A Global Interagency Working Group has released the Terminology Guidelines for the Protection of Children from Sexual Exploitation and Sexual Abuse, taking an important step in strengthening collaboration to address the sexual exploitation and sexual abuse of children.
「ルクセンブルク・ガイドライン」とも呼ばれるこの『用語ガイドライン』は、一般に子どもの性的搾取や性的虐待について言及する際に用いられる複雑な語彙の集まりを解釈をする上での有用な手引きとなる。
The Terminology Guidelines, also known as the Luxembourg Guidelines, offer guidance on how to navigate the complex lexicon of terms commonly used when addressing the exploitation and sexual abuse of children.
『ガイドライン』は、"child pornography (児童ポルノ) “ や ”child sex tourism (児童売春ツアー)、 “child prostitution (児童売春) “といった用語に関し、その使用について的確な助言を提供する。
The Guidelines make precise recommendations on the terminology to use when it comes to terms such as ‘child pornography’, ‘child sex tourism’ and 'child prostitution’.
ICPOは、とくに被害者の特定等の業務が関わる法の執行活動の文脈からも、国際的に認知され、調和された用語集が開発されたことを歓迎する。
INTERPOL welcomes the development of harmonized and internationally-recognized terminology in this area, particularly in the context of law enforcement activity, including victim identification.
当機構のVulnerable Communities Unit (弱者コミュニティ対策ユニット) では、子どもの性的虐待や搾取の問題を矮小化しないため、適正な用語の使用を常に支持してきた。
Its Vulnerable Communities Unit has always supported the use of appropriate terminology to avoid trivializing the sexual abuse and exploitation of children.
警察機構がみな「同じ言葉」で子どもの性的搾取に対する闘いに臨めるよう、当機構は、これらガイドラインをベストプラクティスとして援用し、190ある加盟国の警察機構で運用されるよう推奨してゆく。
To ensure that police are 'speaking the same language’ in the fight against child sexual exploitation, the Organization will implement these guidelines as best practice and recommend their use to law enforcement across its 190 member countries.
『ガイドライン』は、世界中の児童保護機関や保護団体、並びに国会議員や報道機関に配布される。その狙いは、関係諸機関、セクター及び国家間におけるデータ収集及び協力体制を強化することにある。
The Guidelines are being made available to all major child protection agencies and organizations around the world, as well as to law-makers and the media. They aim to build consensus on key concepts in order to strengthen data collection and cooperation across agencies, sectors and countries.

「IWG」
※1 IWG: Interagency Working Group on Sexual Exploitation of Children (児童の性的搾取に関する国際関係機関ワーキンググループ)とは、「子どもへの暴力」に関する国連事務総長特別代表、国連人権高等弁務官事務所 (OHCHR)、「子どもの人身売買、児童売春、児童ポルノ」に関する国連特別報告者等の個人、及び児童の権利に関する国連委員会、国連児童基金 (UNICEF)、国際労働機関 (ILO)等の国連の諸機関や関連機関、欧州評議会、ユーロポール、インターポール等の政府間機関、 米州子ども研究所 (IIN) 、 国際行方不明・被搾取児童センター (ICMEC) 等の研究機関、及びセーブ・ザ・チルドレン、PLANインターナショナル等の非政府機関 (NGO) 等18の団体と個人が参加する、関係諸機関の国際ワーキンググループ。タイに本部を置く非政府組織EPCATインターナショナルが主導して2014年9月に設立された。
「ルクセンブルク・ガイドライン」
※2 『ルクセンブルク・ガイドライン』（The Luxembourg Guideline）とは、 IWGが2016年1月に発表した "Terminology Guidelines for the Protection of Children from Sexual Exploitation and Sexual Abuse (児童を性的搾取及び性的虐待から保護するための用語ガイドライン)。114ページに及ぶ包括的なガイドラインで、児童に関わる性的搾取行為や性的虐待行為に関して国際機関、政府機関や警察機関が使用するあらゆる表現・用語を網羅し、これらに対する「適切な用語」を提案する。日本でムーブメントとなった、法定用語としての「児童ポルノ」にかわる用語としての”child abuse material (児童虐待表現物 “ という言葉は、この議論から生まれた結果の一部だった。全体のどういったコンテクストでこの用語に落ち着いたのかについては、『ガイドライン』本編 （PDF) を参照（p.38～40）。
